The Promulgation and Implementation of Permanent Constitution will bring the Stability of South Sudan

April 27, 2016 (SSB)  —-  Different people have different opinions and reaction times depending on the nature of problems in societies where they exist also the degree at which what they should have said is peacefully resolved or not resolved by the government urgently as expected by the victim. As a citizen who responded in name of this country, I have vehemently got disappointed and decided to speak out on the numerous problems that have covered the pages of my notebook since we gained the country’s independence on 9th July 2011.

Today, it’s puzzled me to air out the points that have got swelled in my stomach which I had observed as loopholes and parameters behind retrogression instead of progression for long time that I have observed, studied, and concluded that the only way forward to dampen and tighten the rope on the neck of those who commit such crimes and for the betterment of our people lives, stable and prosperous future development of South Sudan is to “make a speedy promulgation and implementation of the current constitution”.

  1. The number of rebellion by those who cling to power in exchange of blood from the citizens when they are removed from the offices as if the titles of such offices are written on their backs, not knowing that even a kid which is not yet born in the womb of a mother is entitled to serve in this country. They took up arms against their own government, kills, looted properties, rape, etc. and afterwards, they came back moving on red carpet, with inflation of ranks got integrated, given position without the rule of law to investigate, and prosecutes the victims of atrocities. My question to the so call human rights and the government itself who always talk of human rights violations of the living ones. Where is the rights of innocent citizens who lost their lives in all these deadly conflict? In fact both of you have betrayed the lives of South Sudanese civilians who died and see no one is convicted.
  2. Public funds embezzlement by the government officials serving in the various institutions and its seems to me like such people are always forgiven while judiciary is kept silence because they are not empowered to perform their duties due to interference of tribalism backup from here and there both at the national level up to the Boma levels across the country.
  3. Tribalism that has given birth to circles of revenge killings amongst others like cattle raiding, etcetera all over the country. “It’s always good to keep cattle if you like drinking milk then wanting it at the times you wants milk from it” government should not just know this finishing communities during election campaigns and times only. By summing up these three fundamental things together without the rule of law to act vigorously on them, then there’s no future of Republic of South Sudan even though we chose to elect the new president year after year or at the end of every tenure. History is always inspiring. Looking back on the progress of the government constitutional system, we are deeply aware that it’s closely constitution connected with arduous struggle and splendid achievements of the SPLA/M and the people who were engaged in this war both within and the diaspora who supported in different ways and with the trial we have blazed and the valuable experience we have gained.

All these can be traced back to the common program the SPLM which was promulgated in 2011 to serve as the provisional constitution adopted at the first session of government preparations that affirmed the heroic struggle for our people against domestic oppression and foreign enemies and their striving for national independence and people’s freedom and happiness over the modern Republic of South Sudan. It has always affirmed the history in which SPLM led the South Sudanese people in winning the victory in the new democratic revolution and acquiring separate state power as we speak, therefore, we should all nodded to the fact that “where we were yesterday isn’t where we are today”.

“To ensure people’s democracy and stabilizes our recurring problems, we must strengthen our legal systems of governance. Democracy has to be institutionalized and written into law so as to make sure that institutions and laws do not change whenever the leadership changes. Of course good and bad leaders come and go leaving behind the nation with new generation.

Or whenever the leaders change their views or shift the focus of their attention” in accordance with the guidelines, principles, and policies set forth, there is need to review on the positive and negative experience in building peaceful coexistence, socialism, drew the hard lessons from the number of war’s over decades ago and the impact of such rebellion on our people in the country and outside policies, learned from the gains and losses of the world sights on us, from socialism to capitalism and adapted to the new requirements of reforms in all cooperation sectors of governance while opening up the peaceful, civilized, modernized South Sudan and the demands of transparent democratic nation in conjunction with improvement of legal systems whereby we promulgated and implemented the current constitution that will investigate, and prosecutes the victims of crimes.

As the fundamental law of the state is made ready, the permanent constitution shall verifies the development concerning the correct path, theories and systems of governance with South Sudanese diversity, demonstrates the common will and fundamental interests of citizens of all religious, ethnic groups, tribe’s, and has to become the supremacy of expression of the central work, basic principles, major guidelines, and importance policies of the ruling party and the state national legal system.

It’s the implementation of permanent constitutional that will keep people vigilant of bad damaging intention before he/she made it effective. People will rely on its supreme legal status and powerful legal forces that will give powers to judiciary in order to dampen the recurring violence which is based on ethnicities at the court level. This will convincingly ensure that the people of South Sudan are the masters of their own country, vigorously promoted reforms and facilitated the cause of human rights, safeguarded national reunification, ethnic unity, and social stability, economic stability, security stability, as well as political stability that will give chances to development. Furthermore, we should all exerted a profound influence on the cultural and social life of our people to realize peace and knowing their rights and demands from their government.

According to my keenly felt observations, the country is in mess and probably will continue to be in mess when such problems are taken as a formula for getting positions from the government simply because oversight mechanisms and pertinent systems to ensure the implementation of permanent constitution aren’t yet completed. Therefore, thieves, rebels, murderers find themselves not prosecuted to give warning to next in line criminals by the region/state and the government agencies. problems concerning the people direct interests remain prominent unresolved in law enforcement and jurisdiction, abuse of power malfeasance and dereliction of duty by the government officials, and lawbreaking by the law-enforcement personnel for personal gain have seriously damaged this country.

There is no point to blame the legal authorities or generally professionals in the judiciary system or even PhDs holders for having sit back and not intervene in such affairs simply because exercising their ideas, knowledge, skills, and experience, will work out when the strong permanent constitution is made available to guide everyone in the country. Lastly, awareness of the need to observe the issues of constitution among citizens and some officials needs to be further enhanced for the safety of our future development and peaceful coexistence. We as citizens and the government must pay serious and close attention to and earnestly solve these problems via constitution wisely.
