SPLM/SPLA comments on the IGAD Special Envoys consolidated Document Title “Text Arising from the 25th August Protocol and Stakeholders Positions, Draft I” dated 22 September 2014.

  1. The consolidated IGAD document:
    1. The content of the document is inclusive of all the position of the Stakeholders as presented in Phase II session 5.
  1. All content of the consolidated document shall be subject to negotiation by all Stakeholders mentioned in May 9, 2014 Agreement without exception.
  1. Format of negotiation
    1. The consolidated document shall be negotiated through the thematic committees as established during Phase II session 5.
  1. The content of consolidated document shall be divided among the thematic committees.
  1. The Key issues in the document that needs special and immediate attention and negotiation priorities are:
    1. The structure of the TFGONU
  • President and Prime Minister
  • Powers and duties of the President and Prime Minister
  • Terms of Office
  1. Leadership of the TFGONU
    • The positions of President and Prime Minister shall be apportioned to SPLM/SPLA and GRSS. Hence, the two parties shall negotiate who takes what.
    • Power Sharing Ratios
  1. Negotiation of the transitional constitution and parameters of the permanent constitution.
  1. Dissolution and formation of the governing structures and institutions of the TFGONU.
  1. Comprehensive Critical Reforms as outlined in April 28, 2014 Agenda.
  1. Compensation for property destroyed, IDPs and returnees to enable them re-integrate into the community/society.
  1. Security Arrangement and Permanent Ceasefire
  1. Adoption/agreement on the permanent ceasefire
  2. Disengagement and separation of forces
  3. Demilitarization of the national capital, state capitals and major towns
  4. Establishment of Joint Integrated Units (JIUs) in the security sector organs
  5. Deployment of UNMISS forces between the two forces
  1. The following Documents shall form the basis of the Terms of Reference (TOR) for the Political Negotiations:
  1. IGAD Agenda Phase II Session III of 28th April 2014;
  1. Agreement on Recommitment to Humanitarian Matters in the Cessation of Hostilities Agreement between the Government of the Republic of South Sudan (GRSS) and the Sudan People’s Liberation Movement/Army (In Opposition) (SPLM/A-IO) on 6th May 2014;
  1. Agreement to Resolve the Crisis in South Sudan, Addis Ababa, 9th May 2014;
  1. Provisional Agenda of 30th July 2014 adopted by the stakeholders on 9th August 2014;
  1. SINGLE NEGOTIATING TEXT ARISING FROM DRAFT II FRAMEWORK FOR POLITICAL AND SECURITY NEGOTIATIONS TOWARDS RESOLUTION OF THE CRISIS IN SOUTH SUDAN, August 13, 2014.

Opinion of the SPLM/SPLA on the Documents Presented by IGAD

  1. The SPLM/SPLA accepts the consolidated document and the attached annexes and recommends that, it is used as the basis for negotiation in Phase II session 6.
