AU Report is sealed guilty verdict on President Kiir and 4 accomplices

African Union Commission of Inquiry into South Sudan crisis (AUCISS) was set up to investigate the crimes commit by both sides in conflict from December 15 , 2013 to date in the country , it was to investigate ‘’ what Dinka have done?’’ and ‘’ what Nuer have done ?’’ . And then present it findings to the panel of experts or jurists to decide, who is wrong? Who is right?
However , the AUCISS has committed two gravest mistakes . First, it presented one side of the story of atrocities , secondly , it turned itself into criminal court by passing a sealed verdict .
In legalese jargon , Sealed Verdict ‘’ is a decision of a jury when there is a delay in announcing the result , such as awaiting for a judge , the parties and attorneys to come back to court . The verdict is kept in a sealed envelope until handed to the judge when court reconvened ’’.
AU Commission of Inquiry has presented Nuer side of the story and has thrown out Dinka side of the story . it has emphasized only Nuer side of the story , which is victim side of the story and thrown out , the villain side of the story , which is the Dinka side of the story . The Commission quoted four Nuer survivors and have not quoted a single Dinka survivor. And the following are four Nuer survivors in the REPORT
‘’It was intense and brutal, and targeted specific groups: only Nuer in Juba’’ said the first Nuer survivor
‘’The violence in Juba targeted one nationality, the Nuer. Those who survived either fled the town by motorized transport, or those who ran on foot to the UNMISS compound’’ said the second Nuer survivor
‘’the killings took place in Nuer residential areas, as a house to house operation. Juba is settled along ethnic lines, and the killings took place in Nuer residential areas, as a house to house operation. One of its survivors narrated the mass killing of 307 persons: “On 16 December, after the fighting in the army stopped, they came house to house to collect and kill. I and three brother were pulled out of the house and taken to the barracks. They put us in a container. Eleven died of suffocation in the container. There were three windows, tiny, but no wind. We were so many we could not sit; we had to stand – the whole day until the night. We heard gun shots all day. They would push people into the container the whole day. 10 at night, they started shooting through the windows that were bringing some oxygen. Then they opened the door and start shooting. It was continuous shooting until all fall down. They opened the door, lit a torch; if they saw you breathing they would shoot. If someone starts crying, they would come back and shoot. This happened four times. There was one boy who we advised to lie still, he ran, got to the door, touched it, it made a sound, and he was killed. Two others were injured in the container, but not dead. Three managed to escape’’. Said third Nuer survivor .
‘’The violence ethnically cleansed the city of Juba of its Nuer population’’ said fourth Nuer survivor .
Here , the Commission gave detailed accounts of what happened to Nuer in Juba .
Then questions are . Where are the testimonies from Dinka survivors ? where are the testimonies of Dinka , who ran from Baliet to Maluth ? or were there was no one killed ? Where are the testimonies of Dinka who ran from Bor to Guolyar ? or were there no one killed ? Where are the testimonies of Dinka who survivor in Akobo when two UN Indian peacekeepers were killed ? where are the testimonies from Dinka women and children who were rescued by Nuer Colonel Padeng at Unity Oilfields in Unity State , after half of them were cut to death by pangas and knife .????
The fact that the Commission skipped the Dinka side of the conflict is an indication. it is politicized one , If it were not politicize Commission , it would have given both sides of story , the Nuer side , the Dinka side .
The whole report is hearsay and concocted because , the Commission has not interviewed any Nuer but complied it reports from NEGATIVE JOURNALISM from Miraya FM , Sudan Tribune , Nyamilepaedia and facebook.
If it actually interviewed any Nuer why has it not interviewed single Dinka survivor? . if it did , then it would have interviewed Dinka and there would have been Dinka testimonies too .
it has turned itself into court , if it were An Inquiry , it would have produced both , Dinka and Nuer , then it would have been to the Jury to decide , who is wrong or right ?
The Commission has turned itself into a Tribunal Court ,the Complaint is Nuer , The Accused is President Kiir , Malong Awan , Amrose Riing Thiik , Bol Madut, the unnamed civilian Major General and Dinka elements .
The witnesses are Hilda Johnson, James Hoth , Peter Nyaba , Mach Paul , Pieng Deng , Dr Majak Agot and Dr Riek Machar .
All these witnesses have testified that President Kiir and Malong Awn , recruited Rescue the President Unit among Dinka from Warrap and Aweil in 2012 and in 2013 the Rescue the President Unit killed Nuer under the Commander of Maj .Gen Bol Akot and Unnamed Major General .
If it were not a court but a Commission, we would have heard other side of the story.
With the above evidences, the Commission Report is sealed guilty verdict awaiting the Judges and read it to the criminals, whether it is death sentence or life sentence, we shall wait to see .
In the court fair hearing OR Inquiry, all sides are given chances to testify or to give their sides of the case before final judgment, or final verdict is decided by the judge. This did not happen. Because ,there are two opposing theories surrounding massacres in South Sudan . There are those who claim a massacre took place in a house to house search of Nuer tribe and there are those who claim there was no house to house search of Nuer , only there was a killing of some civilian in a cross fire .
Where is the cross fire KILLINGS claims in the report? it it were a partial or neutral Commission . we all read what Kiir and his men did . Where are what Riek and his men did? Hearsay and lies will not solve any problem in South Sudan. Mark My Words.
